2.3 License Grant

3. User-Generated Content Rights

3.1 Ownership

You retain all ownership rights to the content you upload, submit, or create using our services ("User Content"), including:

  • Images, artwork, and graphics

  • Social media posts and marketing materials

3.2 License to Tunes On Top

By uploading or submitting User Content to our services, you grant Tunes On Top a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content solely for the purpose of:

  • Providing and operating our services
  • Creating AI-generated content based on your inputs

3.3 Representations and Warranties

By submitting User Content, you represent and warrant that:

  • You have obtained all necessary permissions, licenses, and clearances

3.4 AI-Generated Content

Content generated by our AI services using your inputs ("AI-Generated Content") is owned by you, subject to the license you grant us as described above. However, we retain ownership of the underlying AI models, algorithms, and technology used to create such content.

4. DMCA Notice and Takedown Procedure

4.1 Filing a DMCA Notice

If you believe that content on our website or platform infringes your copyright, you may submit a DMCA takedown notice to our designated Copyright Agent. Your notice must include:

  • A physical or electronic signature of the copyright owner or authorized representative
  • Identification of the copyrighted work claimed to have been infringed
  • Identification of the material that is claimed to be infringing, with sufficient detail to locate it
  • Your contact information (name, address, telephone number, and email address)
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner
  • A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

4.3 Our Response

Upon receiving a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material
  • Notify the user who posted the material of the removal
  • Terminate the accounts of repeat infringers in appropriate circumstances

4.4 False Claims

Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing may be subject to liability for damages. We may seek damages from any party that submits a notification or counter-notification in bad faith.

5. Counter-Notification Procedure

5.1 Filing a Counter-Notice

If you believe that material you posted was removed in error or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notice must include:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief that the material was removed due to mistake or misidentification
  • Your name, address, and telephone number
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if outside the United States, any judicial district in which we may be found
  • A statement that you will accept service of process from the person who filed the original DMCA notice

5.2 Our Response to Counter-Notice

Upon receiving a valid counter-notice, we will:

  • Forward the counter-notice to the original complainant
  • Inform them that we will restore the removed material in 10-14 business days
  • Restore the material unless the copyright owner files a court action seeking a restraining order

6. Repeat Infringer Policy

In accordance with the DMCA and other applicable laws, Tunes On Top has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers.

We may also, at our sole discretion, limit access to our services and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

7. Fair Use and Licensing

7.1 Fair Use

We recognize that certain uses of copyrighted material may be considered "fair use" under copyright law. Fair use is a legal doctrine that allows limited use of copyrighted material without permission from the copyright owner for purposes such as:
